As of 1 July 2020, the Electrical Safety Standards in the Private Rented Sector (England) Regulations 2020 require landlords to ensure that their properties meet current electrical safety standards, as outlined in the 18th edition of the Wiring Regulations (BS 7671). Landlords must obtain a satisfactory Electrical Installation Condition Report (EICR) from a qualified and competent person, confirming compliance.
Key Requirements:
- New Tenancies (from 1 July 2020): Properties let on or after 1 June 2020 must have a valid EICR by 1 July 2020.
- Existing Tenancies (from 1 April 2021): Properties with tenancies that began before 1 June 2020 must have a valid EICR by 1 April 2021.
Landlord Obligations:
- Obtain an EICR: Arrange for a qualified electrician to conduct an electrical inspection and provide an EICR.
- Provide Copies: Supply a copy of the EICR to existing tenants within 28 days of the inspection and to new tenants before they move in.
- Retain Records: Keep a copy of the EICR for the next inspection and provide it to the local authority upon request within seven days.
- Address Remedial Work: If the EICR indicates remedial work is necessary, complete it within 28 days or a shorter period if specified, and obtain written confirmation that the work has been completed satisfactorily.
